By creating an account and using CommissionDoctor, you agree to the following terms.
1. Acceptance of Terms
By creating an account or using CommissionDoctor ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
CommissionDoctor provides commission statement analysis, audit, and tracking tools for licensed insurance producers and agencies. The Service analyzes commission PDFs and identifies payment discrepancies, missing months, and client payment histories. Access requires an active paid subscription.
3. Subscriptions & Billing
Subscriptions are billed monthly or annually via Stripe. By subscribing, you authorize recurring charges to your payment method. You may cancel at any time; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time. Failed payments may result in temporary suspension of access.
4. Pricing Changes
CommissionDoctor reserves the right to change subscription pricing at any time. You will be notified of any price changes at least 30 days in advance via the email address on your account. Continued use of the Service after the effective date constitutes acceptance of the new pricing.
5. Onboarding Packages
Onboarding packages are one-time purchases available to active subscribers only, enabling upload of up to 12 months of historical commission statements. Onboarding packages are non-refundable once the upload process has begun. Onboarding access expires 12 months from the date of purchase.
6. Data & Privacy
Your commission data is encrypted in transit and at rest using industry-standard protocols. We do not sell, rent, share, or use your data for any purpose other than operating your account and providing the Service. You retain full ownership of all data you upload.
7. Acceptable Use
You agree to use CommissionDoctor only for lawful purposes and only with commission statements for which you are the authorized recipient. You may not share account credentials with others, attempt to reverse-engineer the Service, upload malicious files, or interfere with the Service's infrastructure.
8. Disclaimer of Warranties
The Service is provided "as is" without warranty of any kind. CommissionDoctor does not warrant that the Service will be uninterrupted or error-free. Commission data accuracy depends entirely on the quality of insurance company statements.
9. Limitation of Liability
CommissionDoctor is a verification and tracking tool only. We are not responsible for errors in insurance company statements or financial decisions made based on the Service. In no event shall CommissionDoctor's liability exceed the amount paid in the 3 months prior to the claim. Always verify discrepancies directly with your insurance company.
10. Indemnification
You agree to indemnify and hold harmless CommissionDoctor, its owners, employees, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
11. Intellectual Property
All software, design, algorithms, and content comprising CommissionDoctor are the exclusive property of CommissionDoctor. Nothing in these Terms grants you ownership rights to the Service or its underlying technology.
12. Termination
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity. You may cancel at any time through the billing portal.
13. Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of California.
14. Changes to Terms
We may update these Terms from time to time. You will be prompted to re-accept updated Terms on your next login. Continued use constitutes acceptance.
